Ever have a buyer for one of your homes that came with a realtor and you were forced to use the realtor’s contract?

We used to hate realtors that brought buyers by to see the house we were selling. Because we knew that:

we’d have to negotiate with the realtor instead of the buyer
we’d have to pay the commission
worst of all, we’d be locked into the standard realtor contract that gave the buyer all kinds of options to back out, even at the last minute while we were paying the mortgage on an empty house, and have lost our other buying leads because of the contract.

Then, I went to our attorney, who also happens to be a real estate investor, and works with many of us, and I asked him if he could come up with a legal means to fix this problem.

Fixed With A Piece Of Paper

What we wanted was some way to modify the realtor’s contract to put us back in control!

Well, it cost a pretty penny, but in the end he came up with a nice 2-page document that we just append to the realtor’s contract, that turns it back into an investor contract with the terms in our favor.

Delays That Make Us Money

With one house, we had a buyer whose loan didn’t close at the contract date—in fact it took an extra 2 weeks. However, since our contract specified in advance that the buyer would pay us $75/day for the privilege of extending the financing, we made an additional $1,050—more than enough to cover the mortgage payment.

What Else Can This Paperwork Do?

With this simple addendum you can be back in control of your sale even if a realtor is involved. For example:

You can make sure the buyer has financing and the down payment before the loan is underwritten, and you’re not be bound by the contract until it is.
Make the buyer put the down payment cash in escrow, so he can’t spend it before closing
Prevent the buyer from asking for additional repairs after the contract is accepted
Not be responsible for any items a buyer might move into the property
Charge daily for any extension of the contract you agree to
Save on closing costs
Have the right to continue advertising and showing the property
Close at your attorney’s office (if you work with an attorney, this can save the sale if (and when!) any problems come up at the closing table
